| Infinite Health respects your privacy. We will use your e-mail, mail address and phone numbers only when we are confirming your Internet order or communicating with you regarding your case and or questions. We assure you, we do not make our email list, mailing list, or phone numbers available to other companies.
Terms and Conditions for Services Offered
1. Interpretation
In these conditions, the following words have the following meanings:
"Contract" means any contract between Infinite Health and the Client for the supply of the Services incorporating these conditions.
"Services" means the provision of a DNA analysis from biological samples the Client provides to Infinite Health.
"Client" means the person(s), firm or company who requests retail Services from Infinite Health.
2. Provision of Services
2.1 The DNA analysis provided by Infinite Health is prepared solely for the use of the Client to whom it is returned. Identigene makes no representation, express or implied, that the result of the DNA analysis is fit for any purpose other than providing a genetic comparison between biological samples supplied to Infinite Health by the Client.
2.2 The biological samples supplied to Infinite Health by the Client are unrecoverable due to the laboratory procedures required to extract DNA.
2.3 Infinite Health reserves the right to use any third party of its choice to undertake the laboratory services for the DNA analysis.
3. The Client's Warranties and Indemnity
3.1 The Client warrants that he/she is legally entitled to perform any particular act either directly or indirectly in order to obtain the biological samples and supply them to Infinite Health for analysis.
3.2 The Client warrants that he/she is legally entitled to possession of the biological samples provided to Infinite Health.
3.3 The Client will indemnify Infinite Health and keep Infinite Health fully indemnified against all costs, claims, demands, expenses and liabilities of whatsoever nature arising from a breach of the warranties in 3.1 or 3.2.
4. Infinite Health's Disclaimers and Liabilities.
4.1 Infinite Health DOES NOT WARRANT TO CLIENT: (A) THAT THE SERVICES PROVIDED BY Infinite Health WILL MEET THE EXPECTATIONS OF THE CLIENT; OR (B) THAT Infinite Health’s SERVICES WILL BE FREE FROM DEFECTS OR FREE FROM ERRORS.
4.2 FURTHER, IN NO EVENT SHALL EITHER Infinite Health OR THE CLIENT BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
5. Third Parties
A person who is not the Client or Infinite Health has no right under the Contracts (Rights of Third Parties)
Act 1999 to enforce any term of these Terms and Conditions but this does not affect any right or remedy for a third party which exists or is available apart from that Act.
6. Governing Law
The construction, validity and performance of these Terms and Condition shall be governed in all respects by Ontario, Canada Law and be subject to the exclusive jurisdiction of the Ontario, Canada Courts.
7. Refund Policy
7.1 100% Refund (*):
1. written or verbal request within 90 days of order date,
2. specimen collection services were not provided (legal cases), and
3. testing had not been initiated.
7.2 50% Refund:
1. written or verbal request within 90 days of order date,
2. specimen collection services were provided (legal cases), and
3. testing had not been initiated.
7.3 No Refund:
1. testing had been initiated or completed, or
2. inactivity of order (on-hold status) for 90 days after order date.
Note: (*) A $25 charge will be deducted from the total refund amount for orders purchased online that qualify for a 100% refund.

| DNA Specimens and Data |
| Unless a specific arrangement is agreed on in writing, the DNA specimens and/or the DNA profile data obtained from the DNA specimens are accessible by the client who had ordered the service, the sample donor, and all other participants included in the case.
A standard storage time of 180 days from the date of reporting is maintained for parentage, identification, maternal, and paternal DNA tests. Once our laboratory information system indicates that the 180 days has elapsed, all remaining samples and their containers are destroyed by incineration. For DNA banking, the DNA is stored for the amount of time agreed on between Infinite Health and the client.

| Online Ordering |
| Online transactions are handled through scripting designed to submit orders with Secure Sockets Layer (SSL) encryption. When you enter your credit card number and personal information into the Infinite Health Secure Order Form, it is transmitted across the Internet in an encrypted (scrambled) form, and decoded once it gets to us. This provides a reliable and confidential ordering environment for your security. Since some browsers do not allow for SSL encryption we also provide a non-secure online ordering options. Additionally, ordering via telephone or fax is always welcome. |
